Law when there is no governing law
Analyzing case law is important for many reasons. Often times attorneys on either side of a case will cite the same statue as being supportive of both of their respective positions. This is usually a matter of interpretation. Discuss who you think should be involved in that interpretation. Should it be lawyers, the judge, the client, the jury? Why? And how will analyzing the other case law help in determining the ultimate interpretation of the statue in question?
