The focus of this learning activity is negligence and product liability.

Scenario: Jon is an experienced skateboarder. He purchased a new skateboard from All Sports, Inc., a sporting goods store. Sensational Skateboards, Inc. manufactured the skateboard.

Jon took his new skateboard to Skaters Park, a privately owned skateboard park in town to try out his new skateboard. After about 30 minutes of skateboarding, the wheels on Jon’s skateboard suddenly fell off. Jon fell and broke his arm and ankle.

A. Does Jon have a legal claim under product liability law? Why or why not? If yes, who could he sue to recover damages for his injuries?

B. Could Jon possibly have a legal claim against Skaters Park under common law negligence? Why or why not?
